  • Certified priority document with verified French translation (can be filed within 3 months)

For a patent of importation, based on a granted foreign patent:

  • Certified copy of the granted foreign patent (can be filed at any time after grant of the patent)
  • Verified French translation (required on day of filing)
  • Power of Attorney, simply signed (required on day of filing)

Novelty:                   Absolute novelty is required

Patentability:       Methods of medical treatment, diagnosis or surgery are not patentable

                                  Pharmaceutical patents are not patentable until 1 January 2016

Excess Fees:         None

Examination:       Applications are subjected to formal examination only

Term of Patent:   20 years from the filing date or on expiry of the foreign patent on which a patent of importation is based

Renewals:               No renewal fees are payable at this stage
